This agreementsets the terms of using the online service www.vitapharm.md. The rights over this service belong to Î.M ,, VITAPHARM – COM ”SRL.

These pages, their content and infrastructure, as well as the online service for the purchase and delivery of the Products are owned and operated by the Company. They are provided for personal non-commercial use only in accordance with the terms and conditions set out below.

The WWW.VITAPHARM.MD website is intended solely to help Users find food supplements and medicines (hereinafter referred to as “Products”), to purchase them online and to benefit from their home delivery. You confirm that you are 18 years of age and have the legal authority to enter into this Agreement and use this website in accordance with all specified terms and conditions. You agree to be financially responsible for your use of this website (as well as for the use of your account by other persons, including, but not limited to, minors living with you). You agree to verify the use of this website by the minors in your care. You also confirm that all information provided by you or by the people living with you is authentic and accurate.

Any speculative, false or fraudulent orders intended for resale are prohibited. You agree that the online purchase of Products from this website will be used only for personalpurposes, for you or for another person in whose favor you are legally authorized to act. You agree that abuse, suspicious acts, signs of fraud or unauthorized use of the products purchased online on this website may cause the Company to cancel all orders affiliated to your name, email address or account and to close all accounts associated with you. If your involvement in any fraudulent activity comes to notice, the Company reserves the right to take any action in connection with you under the legislation of the Republic of Moldova.

PRICE OF SERVICES

All prices on the site include VAT and other taxes (which can be changed). Obvious errors related to prices (including printing) do not oblige the Company with anything from a legal point of view. All promotions and special offers are marked accordingly.

For certain types of products presented on the site, the price may be indicated incorrectly. The company reserves the right to change the incorrectly indicated prices on the site and / or on orders awaiting confirmation thatare priced incorrectly. In this case, if possible, the Company will offer the possibility to confirm the pending order, subject to price changes. Otherwise, the Company will cancel the order without any penalty. The company is not obliged to supply the purchased goods at a wrong (lower) price, even after the order confirmation has been sent to you.

By accepting payment via MasterCard and VISA cards the website allows the User to associate the customer experience on the site with the customer experience via payment cards. At the same time, the Company complies with the international rules of payment systems, by publishing the logos “Verified by Visa®” and “MasterCard® SecureCode ™” on the company’s website but alsoother compliance logos provided by the bank, both during payment and transactions and during other actions related to the activity of the website, as described in this User Agreement.

USER REGISTRATION.

In order to use the Company’s services or some of the individual functions of the services, the User must follow the procedure of registering the order. The User must also provide personal data in various forms on the site, for the registration of requests.

For registration, the User must provide accurate and complete information to the questions in the registration form and keep the presented information up to date. If the User provides incorrect information or the Company has reason to believe that the information provided by the User is incomplete or inauthentic, the Company has the right, in its sole discretion, to deny the User the use of its services (or their individual functions).

The Company reserves the right to ask the User to confirm the data specified during registration at any time and to request supporting documents. Failure to present thosedocuments may be equated with the provision of false information and may lead to blocking the User and to refusal of giving access to services (or individual functions).

            The User is solely responsible for all actions (as well as their consequences) related to the use of the site services, through the User’s account, including in cases when the User voluntarily transmits access data to his/her account to third parties, under any conditions (including under contracts or agreements).

The User mustimmediately notify the Company about any unauthorized access (not permitted by the User) to the Company’s services, use of the User’s data, and / or of any breach (suspicion of breach) of confidentiality.

The user has no right to reproduce, repeat, copy, sell, resell or use any part of the Company’s services for commercial purposes.

The Company reserves the right to block the User and to prohibit access to certain services by using any account, and to delete any content without explanation, including if the User violates the terms of the Agreement or the terms of other documents specified in this Agreement.

PROMOTIONS AND SPECIAL OFFERS

The promotions and special offerspresented on the site comply with the regulations created by Î.M,,VITAPHARM – COM” SRL.

These regulations are shared with the users only through thewebsite or by e-mail. The promotions presented on the site are valid within the mentioned time period, and if no time period is mentioned, they are valid within the limits of available stocks.Î.M,,VITAPHARM – COM” SRL reserves the right to interrupt or cancel a promotion at any time without prior notice.

• The right to withdraw consent is the right to withdraw, at any time, consent for the processing of data;
• The right to restriction of processing is the right to obtain from the company restriction of processing of your Data in certain situations regulated by law (especially if you dispute the accuracy of the Data or if the processing is illegal but you oppose the deletion of the Data). In these situations, except for storage, the Data will not be processed.
• Right to file a complaint is your right to file a complaint regarding the way Data is processed. The complaint is submitted to The National Supervisory Authority for Personal Data Processing.
